Legal Protection of the Environment Under Libyan Law
Abstract
Research Summary
It is known that man lives in an environmental environment subject to pollution all the time and without any preliminaries and with behavior that may be unintended to harm the environment, but this matter affects the environment with serious pollution that leads to a loss of the natural balance between the environmental elements and within which interactions take place, and the interrelationships between creatures, which made man live in a state of turmoil and anxiety, and from this point of view, the problem of environmental pollution received great attention from researchers, specialists, men of science and law.
One of the results of the industrial and commercial renaissance witnessed by human societies was the entry of elements and chemicals into our daily life for use in various purposes, which led to the creation of a state of confusion in the environmental balance, leading to the occurrence of many abnormal phenomena, whether in the atmosphere, land or water medium. . This was met internationally by the Stockholm Declaration of 1972, which is considered the first declaration specialized in the protection of the environment. From this declaration, the environmental law was established internationally, and institutions and centers have been created in all countries of the world to take charge of environmental sanitation and direct various activities in the direction that leads to the preservation of the environment. With the belief that environmental deterioration can only be controlled and prevented by ensuring that all parties causing this deterioration are responsible for their actions and that they contribute in good faith with all parties to improving environmental conditions at the local and global levels.
Through many international conventions and urging countries to issue legislation to protect the environment, Libya issued Law No. 7 of 1982 regarding environmental protection and then canceled it because it needed some development over time, and then issued Law No. 15 of 2003 on environmental protection and improvement, based on Accordingly, I divided this research into two sections: The first topic was devoted to the historical stages that the legal protection of the environment passed through, starting from the issuance of non-specialized laws that stipulate texts that protect the environment to the issuance of another specialized law for the protection of the environment, then the second topic was devoted to talking about the legal protection of the environment. In accordance with Law No. 15 of 2003, and in the end I reached many observations and criticisms about Law No. 15, and I also concluded the research with a conclusion showing what I found at the end of the research.
