The study aims to shed light on the impact of technology on litigation، and we attempt to present what electronic litigation is، and the Arab experiences in the field of technological، electronic، or remote litigation. We also point out the Arab experiences in the field of electronic litigation، and the characteristics of digital judiciary and virtual courts، in addition to presenting the most important Challenges or obstacles that may face electronic litigation in Arab countries.
The study relied on the comparative analytical approach to clarify the texts related to the guarantees related to the protection of litigants in electronic judiciary، and to identify the experiences of Arab countries in the path of electronic judiciary or remote judiciary.
The study concluded that electronic litigation contributes to improving the speed of work in the justice system، as technology can be used to speed up litigation procedures and implement judgments، and reduces costs، as technology can be used to improve work efficiency and reduce paperwork and administrative procedures.
It concluded that the legislation in force does not interact with modern international legislation and model laws issued by the United Nations، especially the guiding legislation related to the use of electronic means in civil and commercial transactions.
